“ANOTHER NEW ADVENTURE” AFFIDAVIT AND RELEASE OF LIABILITY

I, _____________________________________, HEREBY ACKNOWLEDGE that I voluntarily applied to participate in activities sponsored, approved and organized by “Another New Adventure” (hereinafter referred to as “ANA”). 

I AM AWARE THAT THESE ACTIVITIES, AS WELL AS ANY ADDITIONAL ACTIVITIES IN WHICH I CHOOSE TO PARTICIPATE, BEAR THE RISK OF INJURY OR DEATH AND I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER AND HEREBY AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH. 

AS LAWFUL CONSIDERATION for being permitted by ANA to participate in activities sponsored, approved, or organized by ANA, I hereby agree that I, my heirs, distributees, guardians, legal representatives and assigns WILL NOT MAKE CLAIM AGAINST, SUE, ATTACH THE PROPERTY OF, OR PROSECUTE owners, heirs, officers, directors, members or contractors of ANA as a result of my participation in these activities.  In addition, I hereby RELEASE AND DISCHARGE ANA from all actions, claims or demands I, my heirs, distributees, guardians, legal representatives, or assigns now have or may hereafter have for injury, death, damage, accident, illness, change, delay, cancellation, error, omission, or weather-related incidents resulting from my participation in these activities. This includes death, injuries, arrests, fines, and prosecution costs related to driving or riding in any vehicles, including to and from airports.  I am aware of the risks involved with alcohol impairment and participating in these activities, including drinking and driving, and agree to hold ANA harmless from any accidents or injuries resulting from alcohol impairment of myself and/or others.

I have also read the Another New Adventure (ANA) Event Policy and the Standard Cancellation and Refund Policy of “Another New Adventure” and agree to the terms and conditions thereto.

“ANOTHER NEW ADVENTURE” (ANA) EVENT POLICY

REGISTRATION

1. Registration is on a first-come, first served basis.
2. Registration is confirmed only when payment is received and if an ANA Trip Waiver form has been completed and signed by the participant and returned to ANA.
3. Registrations will be accepted in person or by mail.
PAYMENT SCHEDULE

1. As outlined on the Event flyer / information sheet
2. If you are late on a payment, subject to cancellation after 5 days.

 MISCELLANEOUS
1. Form of payment accepted:  Personal check, money order, or cash,  NO CREDIT CARDS accepted.
2. Check returned for insufficient funds:  $25.00 service fee plus any bank charges to ANA.
3. Stop Payment:  Automatic cancellation from the event and elimination from participant from all ANA activities for minimum six (6) months.
4. For events with a price less than $100.00, the cancellation fee is 10%, with a $5.00 minimum.
STANDARD CANCELLATION AND REFUND POLICY
To cancel from an event, the participant must notify ANA in writing or by email.
Cancellation Schedule:
A.    Cancellation 90 days or more before departure: Full refund less Administrative Fee plus any travel-imposed penalties.
B.    Cancellation less than 90 days before departure: Administrative Fee plus any fees imposed by ANA and travel-imposed penalties.  Event must be resold.  Refunds will be issued 2 - 4 weeks after completion of the event.
C.    Administrative Fee = $25.00. 

REFUNDS
1. Refund will be for amount paid less any cancellation charges.
2. No refunds will be issued until participant has been replaced on the event and the event has returned.
3. Penalized participants may appeal any liquidation costs within two (2) weeks of receiving a refund by notifying ANA in writing or by email.
4. The Administrative Fee cannot be appealed.
5. ANA will not be responsible for changes in airline flights. ANA will not refund monies because of changes by the airlines unless the airlines refund   monies paid by ANA on behalf of its participants. Changes include, but are not limited to changes in flight times, flight numbers, airline carriers, delays of flights, and cancellation of flights.  

WAIT LIST
1. A check for the required deposit or full amount of the event is required to be placed on the Wait List for the event.  No one may be placed on the Wait List until the event is filled.
2. Available positions on the event will be offered to those on the Wait List in the same order they sign up. Acceptance is required at the time of notification; declines will either be returned to the bottom of the wait list or removed from the list and checks returned.
3. Anyone on the Wait List is subject to the Event Policy as soon as you accept a position on the event.
4. If you are placed on the event, your deposit will be credited toward the event payment. Any additional amounts are due within seven (7) days of notification, or prior to event departure, whichever comes first.
5. Anyone canceling after clearing the Wait List will be assessed penalties under the standard cancellation policy.

EVENT CANCELLATION
1. Cancellation of the event may occur, if in the judgment of ANA:
        a. The event is financially impractical.
        b. Severe or inclement weather exists locally, en route, or at the destination.
        c. Other reasons, as specifically stated by ANA, exist.
2. If an event is cancelled due to any of the above reasons, a full refund will be issued, minus travel-imposed penalties assessed to ANA.

UNSCHEDULED RETURNS FROM AN EVENT
Early Return: The decision to return early will be made by ANA.  All refunds, if any, are subject to the refund policy. Any participant who, at the discretion of the trip captain, is being disruptive, unruly, or whose conduct is causing a problem, can be asked to leave the trip and will bear his/her own costs to return home.
Late Return: The decision to return past the scheduled time will be made by ANA.  If the event of a late return, the participants will be responsible for additional lodging, transportation, and other costs, such as lost tickets and meals.  ANA is not responsible for reimbursement for missed time from work or other expenses. 

RESTRICTIONS
1. Controlled substances: Anyone carrying a controlled substance without the proper paperwork (prescription, doctor’s note, etc.) forfeits all rights, privileges and refunds and may be sent home at their own expense.
2. Other restrictions: Firearms, narcotics, explosives and other items of this nature are prohibited.  ANA assumes no responsibility for anyone carrying these items.
CHANGES
Any and all activities, lodging, and transportation are subject to change at any time due to the following: Consequences as a result of inclement weather, including but not limited to, rain, lightning, thunderstorms, tornadoes, and hurricanes; Airline / Ferry / Shuttle/Transportation/Transfer changes; political uprisings; any upgrades deemed necessary by the trip captain, and any other reasons deemed necessary by the trip captain.

INJURY AND DAMAGES
ANA includes owners, heirs, officers, directors, members or contractors
ANA is not responsible for:
1. Injuries incurred by event participants.
2. Damage to property belonging to others. Restitution is the sole responsibility of the guilty individual(s).
3. Health problems incurred whether from airborne illnesses, food, contagion, or any other type of illness.
4. Consequences as a result of inclement weather, including but not limited to, rain, lightning, thunderstorms, tornadoes, and hurricanes. Consequences include but are not limited to the inability to participate in some or all planned activities, injury or death.
5. Problems with roommates, including but not limited to theft, illegal drug use and bodily injury.
6. Any situation arising from the use of alcohol, drugs (whether legal or illegal), or any other substance. This includes drinking and driving.
7. Accidents or injuries from moving vehicles, including but not limited to autos, busses, motorcycles, ATVs, scooters, trains, airplanes, and boats.
8. Costs related to delays or cancellations of airline flights.

RENTALS/USE  OF MOVING VEHICLES
1. Participant will bear all liability for injuries, accidents, property damage, and any other costs related to the use of rental vehicles, whether a driver or a passenger.
2. Driver participants will be responsible to the rental company for damage to the rented vehicle and will deal directly with the rental company. ANA assumes no liability for injuries, accidents, property damage, or any other costs related to the use of rental vehicles.
3. All participants are encouraged not to operate a vehicle while under the influence of alcohol or drugs. ANA is NOT responsible for damage or injuries or any other incidents incurred while operating a vehicle under the influence of alcohol or drugs. Passenger participants assume all responsibility and liability for their safety if riding with a driver under the influence of drugs or alcohol.
4. ANA is NOT responsible for accidents, injuries (including death), tickets, fines, or any other costs related to the use of rental vehicles.
5. Rental vehicles include, but are not limited to cars, trucks, boats, jet skis, motorcycles, ATVs, and RVs.

 INSURANCE
All trip participants should carry medical, travel, liability, and auto insurance. ANA is not responsible for accidents, additional travel expenses, or medical emergencies.
